The Law Society of British Columbia, McCarthy Tetrault, and its law partner, Herman Van Ommen, were represented by Michael Armstrong of the small law firm of Armstrong Simpson in Vancouver.
The Law Society of British Columbia is exceedingly corrupt and it is self-insured.  This means that if there is a large negligence claim or other claim against a lawyer or law firm all lawyers in the province of British Columbia would are required to pay out.  The massive size of the claim of Sun Belt Water Inc. was a threat the Law Society did not take lightly.  In addition, the Law Society of British Columbia is closely linked to the Ministry of the Attorney General for British Columbia where many of the crimes took place.

McCarthy Tetrault is one of Canada's largest law firms and very often represents the Law Society of British Columbia in lawsuits against it.  However, McCarthy Tetrault and its law partner, Herman Van Ommen, were named as Defendants in the lawsuit, so it could not act.  Herman Van Ommen has a notorious reputation for being the Law Society hatchet man who takes down honest lawyers doing a good job for their clients against the Canadian State.

The first tactic of Michael Armstrong was to respond to the invitation of the Federal Court to make an application to dismiss the lawsuit filed in the Federal Court against his clients.
